Xponent Acceptable Use Policy (AUP)

Definitions

  • Host, We, Our, Us: Xponent (the Webhosting Provider).

  • Owner, User, You, Your: The paying Customer.

This Acceptable Use Policy (AUP) is an integral part of your agreement with Xponent for the provision of services (collectively, the “Services”) as detailed on our Hosting plans page.

This Policy is designed to protect our customers, systems, and the broader internet community from irresponsible, malicious, or illegal activities. This is a non-exclusive list of prohibited actions. Xponent reserves the right to modify this Policy at any time, effective upon notice to you. Xponent retains the sole and absolute right to interpret, apply, define, and implement this Policy.

1. Scope of Service & Platform Restrictions

WordPress Hosting Exclusive

Xponent provides managed hosting exclusively for WordPress and WordPress-compatible plugins and themes.

  • The execution of any other software applications, scripts, or frameworks is strictly forbidden.

  • Xponent retains the right to audit all customer-supplied code for performance, stability, and security concerns, and may allow or disallow code at our sole discretion.

2. Prohibited Content and Activities

Illegal Use

The use of Xponent’s services in a manner that violates local, national, or international law is strictly prohibited. This includes, but is not limited to:

  • Death threats, terrorist threats, or threats of physical harm to individuals.

  • Identity theft, doxing, and other severe invasions of privacy.

  • Credit card fraud, racketeering, defamation, and slander.

Offensive & Harmful Content

You may not use Xponent’s services to host, distribute, or link to content that Xponent determines to:

  • Exploit Minors: Relate in any manner to child pornography, child exploitation, bestiality, or non-consensual sex acts.

  • Incite Violence: Threaten or encourage physical harm or violence against individuals or groups.

  • Deceive Consumers: Host multi-level marketing (MLM), Ponzi schemes, or pyramid schemes.

  • Compromise Safety: Create a risk to public safety, health, national security, or interfere with a law enforcement investigation.

  • Violate Intellectual Property: Infringe on copyrights, trademarks, patents, trade secrets, or proprietary information (including tools designed to defeat technical copyright protections).

  • Promote Illegal Goods: Facilitate illegal drug trafficking, illegal arms trafficking, or illegal gambling.

  • Malicious Intent: Harass, threaten, or solicit conduct that is otherwise illegal or fraudulent.

3. System and Network Security

Denial of Service (DoS)

The use of Xponent’s services to conduct or participate in Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks is strictly prohibited.

Server Abuse & Hacking

Any attempt to undermine, disrupt, or cause harm to an Xponent server, network component, or another Xponent subscriber is prohibited. Forbidden actions include:

  • Unauthorized Access: Logging into a server, account, or database without explicit authorization.

  • Data Interception: Accessing, tampering with, or expropriating data, traffic, or systems not intended for your use.

  • Security Circumvention: Testing, probing, or breaching security or authentication measures without express written consent from Xponent.

  • System Overloading: Interfering with service to any user, host, or network via “flooding,” “mail-bombing,” “crashing,” or intentionally overloading system resources.

Malware, Phishing & Fraud

  • Malware Distribution: The storage, distribution, fabrication, or deployment of viruses, trojan horses, worms, rootkits, password crackers, adware, or keystroke loggers is forbidden.

  • Phishing: Any activity designed to collect personal information (credentials, financial data, identity details) under false pretenses will result in immediate service termination.

4. Email and Anti-Spam Policy

Unsolicited Email (Spam)

You may not send unsolicited bulk or commercial emails. Email is considered unsolicited unless you have a documented, pre-existing relationship with the recipient or they have explicitly opted in to receive your communications. All email marketing must comply with applicable global regulations, including the CAN-SPAM Act.

Message Integrity

You are prohibited from obscuring, forging, or misrepresenting email headers, return addresses, or routing information.

Abuse Complaints & Blacklisting

  • Complaints: Reports from recipients or third-party abuse agencies (e.g., Spamhaus, Spamcop) will be deemed proof of spamming unless you provide clear, compelling evidence to the contrary.

  • Service Termination: Xponent reserves the right to terminate email services if your account generates excessive complaints or if your assigned IP addresses/domains become blacklisted, regardless of direct fault.

5. Administrative Access and Reselling

Xponent Administrative Access

To ensure efficient server management, security monitoring, and automated maintenance, Xponent servers maintain administrative access protocols.

  • Xponent takes all reasonable industry precautions to protect client data privacy and system security.

  • You must not tamper with, disable, delete, or alter any administrative tools or access controls installed by Xponent.

Reseller Responsibility

If you resell, rent, or allow third parties to utilize Xponent Services, you assume full responsibility for their compliance with this AUP. Any violation by a third party utilizing your account will be treated as a violation by you.

6. Law Enforcement and Reporting

Legal Disclosures

Xponent complies with valid legal processes. When presented with a legitimate subpoena, court order, or government warrant, we will disclose requested customer information as legally required. To the extent permitted by law, Xponent will make commercially reasonable efforts to notify you of such data requests.

Reporting Violations

To report an alleged violation of this AUP, please contact our abuse team via email. Reports must include your verified contact information, the offending domain/IP address, and clear documentation or evidence of the violation.

7. Violation Resolution Process

Xponent aims to balance customer business continuity with strict network integrity. Our staff will work with you to mitigate issues before enforcing service interruptions, provided there is a good-faith effort to comply.

Disclaimer: Xponent retains the sole discretion to refuse new service to any individual, group, or business entity. We reserve the right to immediately discontinue or terminate services for accounts with excessive, severe, or repeated violations.
